1. Who processes your personal data?
SAS Spar’Car, whose registered office is located at 350 chemin Sarrault, 97232 le Lamentin - Martinique, is responsible for processing the personal data collected via this website.
2. For what purposes is your personal data collected?
Spar’Car processes the personal data you provide via this website for the following purposes:
a. Creating a customer record and a booking;
b. Modifying the booking;
c. Communicating with you about your booking;
d. Performing, managing and invoicing the rental contract;
e. Managing the collection of any amounts due following a change to the contract, damage, etc.;
f. Handling traffic fines, for example by sending your details to the Agence Nationale de Traitement Automatisé des Infractions (ANTAI);
g. Managing claims files following an accident report.
No data is used for commercial purposes (email marketing); it is only used for the rental contract and related events.
3. How long is your data kept?
Paper rental contracts are archived and kept for 2 years from the date the vehicle is returned. Customer records containing permanent and contact information are stored electronically, as they may be reused for a future booking, but are not used for any other purposes.
Bank details (card number excluding CVV, bank account details) are kept for 30 days from the end of the rental contract in order to process payments or refunds relating to any fines, claims or changes to the contract.
4. Who are the recipients of the collected data?
a. Employees of Spar’Car, for purposes relating to the booking and the rental contract;
b. ANTAI and the Public Prosecutor’s Office of Martinique, for the processing of traffic fines;
c. SAAR (our insurance company) for handling claims files. None of your personal data is transferred outside the European Union.
5. How is your data secured?
a. User access control:
Access to the server is granted using a username and password generated by an administrator and is restricted to Spar’Car employees.
b. Software protection measures:
Software and antivirus updates, as well as data backup and recovery procedures, are provided under an IT maintenance contract with the company M.R.I Run.
c. Data encryption:
Our website is accessible via HTTPS and the data is protected through the use of TLS.
6. What are your rights regarding the processing of your personal data?
a. Right of access: you may at any time request confirmation as to whether or not Spar’Car is processing your personal data, access that data, and obtain information and explanations about how it is processed;
b. Right to rectification: you can have your information corrected. You may request the rectification of inaccurate or incomplete information concerning you;
c. Right to erasure (right to be forgotten): you have the right to request the deletion of personal data concerning you;
d. Right to object: you may object to your data being used for a specific purpose.
